Terms of Service for Twice LLC

These Terms of Service ("Terms") govern your access to and use of the Twice LLC website ("Website") and any related services, including APIs, tools, or software provided by Twice LLC ("Services"). By accessing or using the Website or Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Website or Services.

1. Acceptance of Terms

By using the Website or Services, you confirm that you have read, understood, and agree to these Terms, as well as our Privacy Policy (linked below). Twice LLC reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Website. Your continued use after such changes constitutes acceptance of the new Terms.

2. Eligibility

You must be at least 16 years old to use the Website or Services. By using the Website or Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.

3. User Accounts

To access certain features, you may need to create an account by providing your email address and other required information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Twice LLC immediately of any unauthorized access or use. Twice LLC may suspend or terminate your account at any time for any reason, including violation of these Terms.

4. Use of Services

You may use the Services only for lawful purposes and in accordance with these Terms. Prohibited activities include, but are not limited to:

  • Abusing, overloading, or disrupting the Services.
  • Reverse-engineering, decompiling, or disassembling any part of the Services, except as permitted by applicable law.
  • Scraping, crawling, or using automated means to access the Services without permission.
  • Using the Services to infringe on intellectual property rights, violate laws, or harm others.

For APIs provided by Twice LLC:

  • Usage is limited to 10 requests per second per user/account. Exceeding this limit may result in throttling, suspension, or termination.
  • You must provide attribution in any application or product using our APIs by displaying "Twice under the hood" prominently and linking back to our Website where appropriate.

5. Intellectual Property

All content, APIs, tools, and software on the Website are owned by Twice LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for your personal or internal business purposes, subject to these Terms.

If the Services include open-source components, they are provided under their respective open-source licenses (e.g., MIT, Apache), which will be specified in the relevant documentation or repositories. You must comply with those licenses when using or distributing such components.

You retain ownership of any content you submit or upload, but you grant Twice LLC a worldwide, royalty-free, non-exclusive license to use, reproduce, and distribute it as necessary to provide and improve the Services.

6. Payments

If you purchase any paid Services (e.g., premium APIs or subscriptions), all payments are final and non-refundable. You authorize Twice LLC to charge your provided payment method for the applicable fees. Prices and features may change with notice. You are responsible for any taxes associated with your purchases.

7. Termination

Twice LLC may suspend or terminate your access to the Website or Services at any time, without notice, for conduct that violates these Terms or is otherwise harmful to Twice LLC, its users, or third parties. Upon termination, your license to use the Services ends immediately.

8. Limitation of Liability

To the fullest extent permitted by law, Twice LLC and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or Services, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Twice LLC and its affiliates from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

10. Governing Law

These Terms are governed by the laws of the United States and the State of Wyoming, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the federal or state courts located in Wyoming.

11. Miscellaneous

These Terms constitute the entire agreement between you and Twice LLC. If any provision is held invalid, the remainder shall remain in effect. Failure to enforce any right does not waive it.
